{"id":607,"date":"2019-09-26T15:26:02","date_gmt":"2019-09-26T15:26:02","guid":{"rendered":"https:\/\/ayoub-associates.com\/blog\/?p=607"},"modified":"2019-09-26T15:26:08","modified_gmt":"2019-09-26T15:26:08","slug":"irs-finalizes-safe-harbor-allow-rental-real-estate-qualify-business-qualified-business-income-deduction","status":"publish","type":"post","link":"https:\/\/ayoub-associates.com\/blog\/irs-finalizes-safe-harbor-allow-rental-real-estate-qualify-business-qualified-business-income-deduction\/","title":{"rendered":"IRS finalizes safe harbor to allow rental real estate to qualify as a business for qualified business income deduction"},"content":{"rendered":"<p>IR-2019-158, September 24, 2019<\/p>\n<div class=\"dialog-off-canvas-main-canvas\" data-off-canvas-main-canvas=\"\">\n<div class=\"pup-main-container container\">\n<div class=\"row\">\n<div class=\"pup-header-content-rt no-gutter col-sm-12 col-md-9\">\n<div class=\"region region-content\">\n<article class=\"pup-article full clearfix row\">\n<div class=\"col-md-12 col-sm-12 col-xs-12\">\n<div class=\"field field--name-body field--type-text-with-summary field--label-hidden field--item\">\n<p>WASHINGTON \u2014 The Internal Revenue Service today issued <a title=\" Revenue Procedure 2019-38\" href=\"https:\/\/www.irs.gov\/pub\/irs-drop\/rp-19-38.pdf\" data-entity-uuid=\"c1d86430-ca2f-4c4d-95ad-d8e79f8449fd\" data-entity-type=\"media\" data-entity-substitution=\"pup_linkit_media\">Revenue Procedure 2019-38<\/a> that has a safe harbor allowing certain interests in rental real estate, including interests in mixed-use property, to be treated as a trade or business for purposes of the qualified business income deduction under section\u00a0199A of the Internal Revenue Code (section 199A deduction).<\/p>\n<p>If all the safe harbor requirements are met, an interest in rental real estate will be treated as a single trade or business for purposes of the section 199A deduction. If an interest in real estate fails to satisfy all the requirements of the safe harbor, it may still be treated as a trade or business for purposes of the section 199A deduction if it otherwise meets the definition of a trade or business in the section 199A regulations.<\/p>\n<p>This safe harbor is available for taxpayers who seek to claim the section\u00a0199A deduction with respect to a &#8220;rental real estate enterprise.&#8221; Solely for purposes of this safe harbor, a rental real estate enterprise is defined as an interest in real property held to generate rental or lease income. It may consist of an interest in a single property or interests in multiple properties. The taxpayer or a relevant passthrough entity (RPE) relying on this revenue procedure must hold each interest directly or through an entity disregarded as an entity separate from its owner, such as a limited liability company with a single member.<\/p>\n<p>The following requirements must be met by taxpayers or RPEs to qualify for this safe harbor:<\/p>\n<ul>\n<li>Separate books and records are maintained to reflect income and expenses for each rental real estate enterprise.<\/li>\n<li>For rental real estate enterprises that have been in existence less than four years, 250 or more hours of rental services are performed per year.
